First Underage Possession of Alcohol Charge
My question involves criminal law for the state of: New York
A car I was in was pulled over before a concert last night and had in my possession alcohol. I'm being charged with Underage Possession of Alcohol and have a clean record. No tickets for anything. I just want to know what to expect and if there are any way to keep it from being put on my record. Is there anything I can do to lessen the charges? What is the best case senario?
basically... how much trouble am I in?
Re: First Underage Possession of Alcohol Charge
You're charged under Alcohol Beverage Control Law § 65-c? If so, that's a civil offense and is not subject to conditional discharge. You're looking at fines, an alcohol awareness program, and probably community service. I don't see any information about a driver's license suspension; which isn't to say that it's not a possible consequence, just that I haven't yet found anything indicating whether or not it's possible based on this offense.
