Absconding with 3rd Drug Charge
My question involves criminal law for the state of: California.
My friend has been in prison 2 pevious times on sales and possession charges, This last parole starting 2001, he absconded, they caught him 3 years ago on a driving with no license charge and absconding, he was sentenced to prop 36, which he gave 2 or 3 dirty tests finally his parole officer decided to have him do an in house, (halfway house drug program) he left there 3 days in, absconding again! Now that was in 2006, April 4, 2009, he was pulled over and arrested for possession of cantrolled substance, false info to a cop, under the influence of control sub. and poss of paraphen. and he has a parole hold for absconding, My question is what is going to happen to him? will they give him a long sentence? or can they sentence him to a in house drug program again.

Re: Absconding with 3rd Drug Charge
Your friend has a serious problem.
But, since he did not go back to prison last time, and the prisons are overcrowded, I would not expect him to do more than 90 days back in prison IF they send him back at all. Chances are good they might just leave him to the county system at this point.
Without knowing his criminal history, the county and the prosecutor, it is all guess work what might happen to him there.

Re: Absconding with 3rd Drug Charge
thank you for responding so quickly. He has no violent offenses only drug related charges, I have one more question, he was driving a roommates car without a drivers license and it was impounded. Now the police said that the roommate has to go to the claims dept./schedule a hearing to get the car back (out of impound) will the roommmate be charged with anything? Like aiding and abedding a parolee at large or letting a person drive it without a valid license?

Depending on the evidence, yes, the room mate could be charged with aiding and abetting a fugitive and/or allowing an unlicensed driver to operate his or her car.
