Re: Any Visitation Rights
The time to dispute parentage was 9 years ago at the child support case. You can always do a paternity test, but you need to know that after this long, even if you are found NOT to be the father, the court can STILL hold you to the deal since you are the father that the child knows. Unfortunately, without SOME order of visitation from the court, you CAN be denied access to the child. The fact that you've been paying support all long will be extremely helpful to your case, but in and of itself doesn't legally establish a RIGHT to visitation. You've got to GET a case going and get a court to ORDER visitation. Check with a couple of local family law attorneys to get some idea of a plan of attack - most will give an initial consultation for free. And take a copy of the current child support order to make SURE there isn't already some small clause in there that DOES compel visitation.

My question involves a child custody case from the State of: Florida
I went through a child support case with my son 9 years ago, and since then i have seen him a total of mabe 2 years. The mom has repeatedly stop all efforts of me seeing him unless she allows me to. We were never married and there was no set times of visitation established at the time of the child support order. Is there anyway to see if i have the right to see him at all without a court order since one was never established at the time of child support and if so what is the standard for that until a court order is established by a judge? Also, perternaty was never established because i never disputed he was mine, so can i dispute it now? Can anyone please help point me in the right direction?
As aardvarc said, you need to file a petition for a visitation order. You can get a low cost consult by calling the Florida Bar Lawyer Refferal Service at 1-800-342-8011.
Yes, paternity was established, when the CS order was issued. It's too late now to contest, the only thing you can do is fight for your right to be a parent to your child by getting a visitation order.
