Child Support and Signing Over Rights
My fiance' is paying child support for twins and never received any paperwork from the courts except that they would be taking it out of his check. He has never received a paternity test either. The mother is currently married and been married for years now and the husband wants to adopt the children and my fiance' wants to sign over his rights because he really does not believe the chldren are his and has no relationship with the them. The mother wants us to pay for the adoption procedures (which was their choice) along with us paying the courts to sign over rights (which we dont mind paying for our choices). Mother says if we dont pay for the adoption procedures she will not agree to him signing over his rights (Sounds to me she is just money hungry). My question is can we sign over the rights with him not knowing if he is the bioligical father, what are the chances that the judge will grant the decision due to her being married and my fiance' never being in their life, and can we still sign over rights with her disagreeing or is that up to the judge? Also if we get a paternity test and he is not the father can we sue her for the amount that he has paid. I am located in Texas...PLEASE HELP!

Since there is a CS order, your fiance was determined to be the legal father.

He should seriously consider agreeing to paying the adoption costs if he really wants to terminate his rights. Depending on the age of the children, the adoption costs will probably be far less that what the remaining CS would be. He should make sure though that the CS order is also terminated if the adoption goes through.
