How to Get a Restitution Payment Reduction
My question involves criminal law for the state of: North Carolina
My husband had been ordered to pay restitution of $50/month (Aug. 2006) at sentencing. Recently he was asked by the courts to submit financial records along with bills, etc. so that the payment amount can be reassessed. In doing so, the payment went up to $300/month. We are making less money now than we were back then. Why is that have they chosen to increase the payment amount? How can we get help getting this payment reduced?

They increased the payment because, based upon the financial information you provided, they believe he can afford larger payments.
If this was a decision by the parole officer alone, you may be able to get the court to review the decision. If it was the court, I expect the judge will want to see a significant change in his financial situation before revisiting the matter.
