    In addition to my earlier post -
    - My daughter is 3 years old. Her dad and I have joint custody. Where he has her primarily of the time. She cries like crazy, because she doesn't want to go back to her dad's house. She constantly says she wants to live with me. She also states they are mean to her and whip her a lot. During court, does my 3 year old daughter DOB 5/13/02 have a say so.

    FYI: the reason she is not with me is due to schooling and my education for our future. Her father just recently graduated from college and married. I don't want joint custody or to be the visitation parent. I want full or primary custody.

    A three-year-old child is not old enough to express a meaningful preference between parents.

    As others have already posted, no, a 3 year old cannot make any decision as far as custodial parent.

    The bigger picture her that I see is the "whipping" of the child. If you feel there is any real truth to this, you need to contact the proper authorities and take the proper steps to see your child is safe.

    But be careful, a 3 year old may exagerate the situation. Do not falsely accuse your ex but if there is honest belief of abuse, you need to address this now.
