US Citizen and an Illegal
Hi folks. Need some education here. I'm a US citizen, she is illegal. She came here in 2002, and her family filed the proper paperwork in 2003 (her folks are citizens). Her case is very close to being reviewed.
My questions are:
1. What's the general process of the petition her family filed? When her case comes up for review (and is approved) what happens next? Who gets the letter stating she was approved? How does the "interview" process work?
2. if she is already in the country, and is approved, what can she do?
3. can we get married while all this is still in transition? what possible situations would we have to deal with until her paperwork is approved?
4. is there a way to change/update her status once we get married (like can I file for her knowing that she is already here when she shouldn't be AND her proper paperwork is in queue for review)? Is there a fine or a fee to get this moving (legally)?

1. If you want to know what her family did, you have to ask them. We don't know.
2. Approved for what?
3. Sure. If she has no legal status, you would have to deal with the fact that some states won't issue a marriage license.
4. We have no idea what's going on in her case, or the background to her case, so we can't tell you what her options might be.
