First Offense MIP
My question involves criminal law for the state of: South Carolina
Hey, well i'm 18, and I was at a party, there were easily 200+ people there. Well, I had not been drinking the whole night. So I was completely sober, no alcohol in my system what so ever. The cops came, and of course everyone ran. Well about 50+ of us stayed. I didn't drive, so I had no choice but to stay. Well, the cops made everyone sit outside behind the house ( it was 20 degrees). They made us sit in age groups. I don't know what happened to the kids under 18, but ppl 18-20 all got Minor in possession tickets, and ppl 21+ all got arrested. Now I had no alcohol in my system, and I even asked if I could take a breathalyzer test. They refused. Now what am I looking at, as of getting out of the ticket? I've heard numerous stories about this whole situation. I also heard a cop got his badge taken away, because they searched females at the party, and no males. Thanks.

Re: First Offense MIP
Sometimes the prosecutor's office will give a special deal in these "mass ticketing" cases, due to the volume of cases involved. You'll find out when you get to court.
If you want to fight the charge (take it to trial) you may have a shot; but the facts aren't exactly sympathetic (a big, underage beerfest/rave?) and if you're taking this to trial I suggest that you get help from a lawyer.
