How Old Does Child Have to Be to Decide
My question involves a child custody case from the State of: Ohio...:wallbang:
Hello...I have a problem and am not sure how to handle...
My ex and I have shared parenting of our almost 11 yr old son. The problem lies where my son only wants to go to his fathers every other weekend.
His father and him use to be very close, that is until his fathers new fiance came into the picture. She has in all honesty changed my ex husband into a totally different person, and not for the better! And now my son absolutley hates to go there!
My question....Is he old enough to decide this or does the judge have to be the one to decide this?

In every state, the age at which the child can decide whether or not to visit his parent is 18. A judge may or may take the wishes of an older child into consideration but is not bound to do so.
However, if there is a court order that the child visit his parent every weekend, then you as the custodial parent are required to see that he does. Until or unless the order is changed, the child MUST follow it. At no age, as long as he is still a minor, is he considered "old enough" to disregard a court order.
