Probation Successfully Completed
My question involves criminal law for the state of: California
I was 1 month away from my probation expiring when I was arrested on new charges. My probation expired before any violations could be filed, so I didn't have a revocation hearing. My question is whether this could be considered to be a successful completion of probation - as in without incident - which could be a way for me to request getting it expunged. I was arrested while on probation, but since nothing was filed and nothing revoked , doesn't that mean it was completed successfully? Technically speaking?
Re: Probation Successfully Completed
If you commit a crime while on probation, the delay in initiating charges on your new crime doesn't give you a "free pass". You still violated your probation.
