Employer Refused to Give Termination Papers
My question involves labor and employment law for the state of: N/A
Hi there, just wanting to receive any general feedback on the following issue, I worked for a small restaurant the summer before I began to attend college, I gave my employer a heads up right from my first interview that I would only be working until the end of august at which date, I would be relocating to another city. Two weeks prior to my last date of work, I asked that my boss draw up the paperwork, so that it could be ready in time for my move, as I needed the information to properly fill out the forms to receive my student loans, she did not get them ready before I left town, I called her on a daily basis, left messages, spoke to other employees and her husband to light a fire because if I did not get my termination papers I wouldnt have all the information I needed to obtain my student loan, well my savings funds ran out (i have a son) ,and still no word, I didnt even have money to buy milk OR my textbooks the whole first month of school,,.. so I just told the student loan ppl that I did not work in the summer prior,therein my funds were transferred, and I began my school year. Everyday I am terrified that I will be slapped with the $20000 fine that is issued if you lie or fraud student loan company, and now that it is tax time, she is calling me everyday saying she needs my social insurance number in order to fill out my termination papers, now after all this time and turmoil she can get ahold of me??? It is because it is a necessaty to her business to get ahold of me, I am bitter about this situation and refuse to give her my social insurance number because she had it on record I know because I wrote the darn thing out on three occasions for her, and I was also hired through a social assistance program, whom also had to provide my SIN.. also why would she continue to pay my wages for months if she never had my SIN????I think she is trying to cover her butt as to not get audeted, but I am scared that if I give my SIN then Osap will find out that I did in fact work and did lie....Any comments on this issue??? The way I see it, if I dont give her the SIN then she will see what it felt like for me months ago when I was panicking to get my loan, and she refused to answer my calls, she will learn a valuable lesson about keeping her paperwork in tact, and also it will save OSAP from finding out that I did lie....Am I in big trouble here??.Any input would be greatly appreciated Thank you!!!!!!

Your state is always relevant, unless you're in a foreign country - in which case you need to be consulting a board or legal professional that serves your country.

I'd say that's a pretty good bet.

US law and Canadian law are very different, and we have no Canadian law responders here.

Pardon me, I didnt mean to ruffle any feathers here, I used this forum before and the responders were aware that I was Canadian and they still helped me...There aren't many forums that are interactive like this one, and I just wanted to hear various opinions about the situation...I would not run into a court room citing this information, because I am well aware this is a US site, like I said I used it before, it was very beneficial, I value the opinions of the intellects who did write me back regardless of the country I come from. Look, we're not discriminating against you here. But the FACT is that US employment law and Canadian employment law are very, very different. We're not refusing to answer because you're Canadian - I'm Canadian myself, even though I've lived in the US a long time. We simply don't know the answers to your questions. The law in Canada and the law in the US are not the same. In the US, with minor exceptions, we don't HAVE such a thing as termination papers. We just plain don't have answers for you.
