Do I Have a Case for Emancipation
My question involves emancipation laws for the State of: Massachusetts
Hello, I am here because I wish to know if I have a chance for emancipation from my parents. I have read the aforementioned thread concerning emancipation. I would like to emancipate because I am consistently dealing with my mother and grandmother's insults and degradation. I am told that my presence is not wanted. My weight is made fun of repeatedly, as well as my taste in women because they do not like my girlfriend. Let me make it clear that I am not leaving for her. That would be highly immature on my part. I also deal with my mother taking my property, that I pay for, and breaking it. I would think that she couldn't get away with that. Not to mention the fact that I'm not allowed communication outside of my house due to the fact that i began researching this topic. She may not agree with my leaving because my mother tends to do anything to make herself look good, including discredit her own son. I need to get out of my household because there are times when I'm not allowed food or the bathroom or I have to sleep on the floor because "I deserve it". My mother has taken a CHINS out on me due to the fact because I made the immature mistake of running away to get away from her. I'm routinely told I'm a disgrace to the family and I'm hit, sometimes with marks, sometimes not. I am in hell disguised as the nuclear family. I get good grades and I have a secret job and I'm paying for an apartment to prove I can pay for myself without my mom. I am also paying for all utilities at the apartment. My record at school is good except for the occasional detention due to tardiness. I don't drink nor smoke. I am a good kid I believe. I don't think I deserve this. Also if I managed to get a recording of my mother telling me I'm not wanted would that be understandable as a verbal contract that would bind her to her words? thank you all very much for all of your answers.

Emancipation laws in MA are very limited and I see nothing in your post to suggest that you would qualify.
If you are being abused or neglected the answer is to contact CPS, not emancipation.

Lets look at your complaints one at a time (my comments in blue):

Remarks about your weight and taste in girlfriends are not reasons for emancipation, and they do not constitute abuse in any but the most extreme cases.

I would think that she couldn't get away with that. Whether you pay for it or not, you are a minor and your mother has the power and the right to take your things.

Judging by the earlier comments, perhaps she thinks you are too heavy, and she is attempting to control your weight. If you are like many American teens, you could stand to lose a few pounds.

In some states, that recording may well be illegal, and would not be admissible in court, but it will not get you emancipated even if it was admissible.

I wish to be emancipated because my mother’s abusive person that has always had men in and out all the time. I clearly understated my case before. I know to you I may seem as one of the rich brats that are on these forums because daddy won't buy them there Lexus so they want to leave. Despite the normal patrons of this forum I am a legitimate case. I have no bedroom, my weight is made fun of when I'm a regular size and the insults do not do anything to "control" my weight.
Have you ever avoided your house because you don't want to hear the arguing and yelling that is perpetual? Have you ever flinched when people that are supposed to love you are around? When you were a kid did you have to worry about weather or not you would be allowed to use the bathroom that night or worry about where you would have to sleep that night? Were you locked in a basement? Not any kid I've talked to has. And concerning my belongings being broken because I'm a minor, shes broken things that I worked for months for. She doesn't deserve to get away with all this. I know that won't have any say in the court system, but you have to admit it is pretty ridiculous. Do I have any hope at all of getting out? And I apologize if I appear to be a whiny, look-at-me type. I just don't want to seem like I am just another suburban kid trying to escape his chores.

It doesn't matter how well we understand and sympathize. Our understanding why you want to leave does not change the law. I can find nothing in your situation that makes you a candidate for emancipation under Massachusetts' very limited emancipation statute. All the sympathy for your situation in the world is not going to make you a candidate for emancipation when the law says no.

It gives you a "case" for DCF to investigate your situation. You could also call the police. They will help you.
You STILL will not be emancipated. Even if.

Please listen carefully.
No matter how bad your sitution is, it will not give you a case for emancipation. That is not the basis on which emancipation is granted. You could come back here and tell us you were STABBED with a knife and it would STILL not give you a case for emancipation.
Unless you meet the criteria set by state law, which is NOT "I have a bad home life" emancipation will. not. happen.
Are we quite clear on this now?

Emancipation has nothing to do with what other people do or do not do. Emancipation has everything to do with YOU. All that matters is whether or not you can 100% take care of yourself with no outside help.
All I hear from too many teens that want to be emancipated is: THEY do this, THEY did that, THEY won't let me do X, THEY make me do Y.
Until you can and do say: I can do this, I can do that, I did this, I do that, you will not be emancipated until you turn 18.

Ok, now I understand. So if I were to go in front of a judge with my 3 months of paid rent and proof of my income my attendance record in school as well as my transcripts and they all were exemplary would I be able then? Sorry if I am rambaling on I just wanna explore all possible solutions

Emancipation is not guaranteed under any circumstances. It is a privilege, not a right.
You can try going in front of a judge with what you suggest. But there is no guarantee that he will approve an emancipation even if.

All those things that you have stated, you should contact CPS...if what you say is true and they find out it is. They will get involoved, and if they notice that you are financially independent and can take care of yourself, and still get an education while still taking care of yourself, emancipated could be an option. But if not, all it would lead to is you being in another person custody. So is it really about you wanting to be in a loving, caring, encouraging enviroment? or you just wanted to be able to do what you want to do?
