    Drug Paraphernalia in the Workplace
    My question involves criminal law for the state of: WI

    I recently found a drug pipe in the bathroom stall at my place of employment. I am a past MJ smoker however havent smoked in months. Long story short I lost the pipe in the plant (I am a shift manager) and the peice was found by two employees whom I am not on good terms with and has prior knowledge of my past chemical usage (information I confided in trust). They turned the the pipe into management saying that they beleive it is mine. Management questioned me and I told them that the pipe was not mine and that I was willing to submit to a drug test on the spot or any time at their convenience. The told me that they turned the pipe over to the authorities, the pipe tested positive for THC and that they were in the process of finger pronting the pipe.

    My question is what are my legal rights and what is the sgnificant of the following:

    1) Me not testing positive for any substance.
    2) The pipe not being in my possesion but possible having my finger pronts on the peice.

    Any feedback will be greatly appreciated.

    Then you should follow the instruction not to post to your own thread.

    Absent a contract that holds to the contrary, if your employer believes you were using drugs at work or possessed paraphernalia at work, they can fire you based on that suspicion.

    I doubt that the police will fingerprint the pipe. But if they do, and that reveals that you lied to your employer about the pipe or your having handled it, you can be fired for that as well.

    Employers are not courts of law.

    They do not have to go to the time and expense required to gather evidence and interview witnesses.

    They can fire you for suspicion... because there is no law that says they can not.
