Do They Have a Case
My question involves criminal law for the state of: Illinois
Hi everyone
I was recently arrested for a shoplifting case of 11 dollars. As I was walking out of he store, the LP grabbed my shoulder and said, "We'd like to take back that item. Please follow us inside." They took the item from me outside of the store and brought me inside for questioning. They took down my information banned me from the store and called the cops. I had a few other things from different stores in my bag and the officer asked me if they were stolen. He said, "If these were stolen, if you tell me you took them, I'll simply dismiss those and we'll just get you on the 11 dollar item." I got scared so I did tell him I took those. He said, ok, we wont get you on those then. He then cuffed me, told the LP's from that store to return those items and brought me to jail. They took down my information again and fingerprinted me and got my mugshot. The store never got me with any evidence. The only evidence they have against me is word of mouth. They didn't even read me my Miranda rights so anything they asked me cant be used in the court of law.
Do they have a case? and if so, what can I get charged with? As of right now, it's a misdemeanor class C. This is my second run in with the law. But not with shoplifting. It's my first occasion with shoplifting. I'm 17 and I have a disorderly conduct under my belt and in the process of getting a diversion already. I have finished all of the requirements and I have a few more months of supervision. Will the supervision be dismissed?
I'm to hire the best attorney in my city for this type of case. I have a meeting with him this monday.

Thank you for your answer. This was in Schaumburg, Cook County at an American Eagle store. Doesn't my past affect this though?

and I'd like to correct it was a Class A, not a Class C.

By the way, your chances of not only getting a diversion for this charge but holding onto the diversion you were already working on approach zero.
