Establishment of Paternity and Change of Surname
My question involves paternity law for the State of: Virginia
My boyfriend is pursuing a paternity suit against his ex-girlfriend because she refuses to put his name on their son's birth certificate. I recently read that if he is found to be the father, his son's last name will be changed to his. Is this true? Does he have to request his son's last name be changed? What happens if the mother does not agree to this? Thank you!

Once he is established as the legal father, he can request the name change. If the mother does not agree, he'll need to prove to the court that the change is in his child's best interests.
