    Swapping Custody - Do I Have to Request Drop of Income Deduction Order
    My question involves child support in the State of: FLORIDA

    Hi All,

    My ex currently has custody of our son. We are in the process of changing custody to me. There is an Income Deduction Order in place so my employer sends the child support directly to the state. The Modification of Custody states that my ex will now pay me and an IDO will be placed with his employer.

    Does the the Modification of Custody agreement need to state that my IDO should be dropped? Or will that happen by default? Or is that another document I must file?

    Yes, that should be included in the modification agreement. You also should have included that ex will refund payments taken after the modification, because it can take several weeks to stop an IDO, especially if the CSE is enforcing the order.
