I have a good friend who is married with four children. He and his ex-wife have two children together. He currently pays $600 per month in support for his two children. His crazy ex is trying to take him back to court to raise his support. My question is whether they will take into consideration the need for him to support his other children. They already qualify for state assistance on their income and if the ex gets even more child support, then they won't be able to feed the other 4 kids...it's tough...He makes about $3300 per month before taxes and the ex wife makes approximately $2400. On a side note, one of the children of this case is not even the biological child of my friend. My friend has accepted this child as his own and has been paying child support for the last 10 years and the child isn't even his. Will this even have an impact on the case? The ex has just sent him a letter asking him to stipulate to keeping the support the same, but get this to pay until the kids finish college; it's due to end in three years but she wants him to pay for at least 7 more years...She's a little psychotic...
The current wife's income, or lack thereof, is not relevent at all. Only the parents' incomes are used.
Florida does not allow deductions for other children. However, FL law does allow a NCP with other children to have a secondary job, with that income being exempt if it is proven that that income is being used to support the other children.
He should not agree to college support, as FL does not mandate that.
$600 per month for 2 children sounds low for the incomes that you claim the parents have. He should expect that the CS will increase, but he can run the numbers through a CS calculator.
