Leaving State and Filing Divorce
My question involves divorce in the State of: Virginia
My husband has had multiple affairs and fathered 2 kids with other women during the past 4 years of our 14 year marriage. I am done with this relationship. I have decided to move to Kansas to be near family. (I have no family in VA). We have no kids. Here are my questions:
1. In which state do I file the divorce?
2. Can I labeled as "abandoning" the marriage?
3. His mom bought me a car and I have been making the payments to her. As the vehicle is financed, can I take the car with me since I am paying for it?
Re: Leaving State and Filing Divorce
1) In the county in which you last lived together.
2) How long do you intend to wait to file? If you just leave in the middle of the night and there's nary a peep out of you? That's abandoning the marriage. If you tell him "I'm done, you're a tool, I want a divorce.", then file for legal separation, it's not.
3) Who is the car titled to?
Virginia divorce laws are explained here.
Good luck to you.
