Freezing Assets - Auto Repo but Not in My Name
My question involves an auto loan or repossession in the State of: Texas
I'm a single mom of three and I recently went through a divorce. I turned over my Lincoln, which is in my ex-husband's name only, to the creditor. In the divorce decree, I was given the auto, but soon found that I could not support all 4 of us and make the $700/month payment.
I was awarded a percentage of the 401k, and decided to take the money for a down payment on a house for the kids and I (since my ex has the one we lived in), instead of rolling it over.
My question is this....Can the creditor come after me for the auto, and more importantly, can they freeze my accounts, seeing that my name is no where on the auto loan???

If you were responsible for the car loan under the divorce judgment, and you're trying to stick your husband with the bill resulting from your neglect of your duties under that judgment, you can expect your husband to come after you for the money necessary to resolve the deficiency.
