Shoplifting laws vary by state. Also, the outcome can vary depending upon her age - that is, whether she is charged in juvenile court or adult court.
we live in california.
she is 15, it's going to be judged in juvenile court.
Most cases that get referred to juvenile court take a little longer to get a date set. I'd think for a first timer she'll get probation, community service and maybe some counseling. If she messes up again while on probation, the court could make life for her miserable.
could you tell me what informal probation is?
do you have a probation officer, have a certain number of hours you have to stay at home, or get drug tested, or anything like that?
or is it just that if you get caught one more time, you get in WAYY moire trouble?
Informal probation is when the probation office has their file and checks to be sure the fulfil all the requirements the judge places, like counseling, community service and so on. Unless there are other reasons to be more harsh the court probably won't make those extra stipulations, as in prior offences, drug abuse things like that. I guess if you want to make a big impression on your kid, you could see if the judge or probation office will put the squeeze on them, they might suggest that you do it though. If your kid gets caught breaking ANY law while on probation even informal, the court takes the punishment to the next level.

Probation for a first timer will probably be in the 6-12 month range, it sometimes depends on an interview. Some Juvi courts set an interview with the probation officer and the offender to kind of feel them out. If they kid has an attitude the length of probation gets longer, if they are remorseful and cooperative, it's less. It's hard to say about you being the one to be the heavy but if you're at your wits end ask the court to give some guidance. I know if I were the one in trouble, I'd rather go to the 'big house' than have my folks dish out the sentence.
Yeah, if I were in your child's situation (which I kind of am). I would no doubt take any punishment from the court just to avoid pain it could cause my parents if my parents if they even find out about my misdeed.
1. i've heard of informal probation ending only after the fine is paid. could that be possible? or having it shorter then six months...
2. me and my husband are thinking of grounding our child from the mall for six months, with the exception of doing community service for the number of hours that she goes.. do you think this would be an appropiate punishment, or way too much?

Personally I don't think that's too much punishment at all.
Speaking from experience, I'm sure your child will be greatful for whatever punishment you issue now when they're older. I certainly would.
