First Offense Shoplifting at Marshalls in Troy, Michigan
My friend was caught shoplifting a $30 item at Marshalls in Troy. He was arrested, given a misdeamour ticket by police and has a court date on Feb. 15th. This is his first such offence. What punishment can he expect? I have ben reading the forum here. Is the diversion or deferred sentence to first time offenders available in Troy Court? I have been told that it is a court policy and different courts in Michigan has different policies - most would allow a deferred sentence (that is no conviction on record if probation is completed without any trouble) to first time offenders but Troy may not as it is very strict even to first time offenders.

What punishment can he expect? Would he get a conviction or a deferred sentence.

He may get probation, fine and/or community service.

Whether he is eligible for an alternative program, that is up to the prosecutor. If the prosecutor wants to give him a break, he will recommend him to the program, if not, the prosecutor may try to convict him.

Hire a lawyer to plea bargain in case the offer from the prosecutor is not reasonable.
