    Threaten with Legal Action
    My question involves collection proceedings in the State of: Virginia
    I have been payments to a debt collector and they still sending me threating letters if not paid in full they will proceed with legal action.If they do what could I use in my defense so I won't have a judgement? I'm on SS disability and only sorce of income.

    What is the debt for?
    How long have you been paying the debt collector?
    Do you have a defense as to why you should not pay the debt & they shouldn't pursue a judgment against you?

    If they would get a judgment against you, SS income is exempt from seizure though you have to let the bank, plaintiff's lawyer & the judge know it's exempt income so the creditor doesn't go after it. They "may" not sue you if they know you only have SS income. (I don't know if you have any other non-exempt assets they can seize.)

    Its a credit card and I was just notified in November and I started to pay In Dec. I got behind during a medical crisis and wrote and told the original creditor the problem and that was all I heard til then Yes they know SS is the only income and I'm fighting cancer.They are accepting the payments but still threating with lawsuit I just don't know they will do they want it all up front not payments.
