    Is My Boyfriend Going to Jail
    My question involves criminal law for the state of: california

    my boyfriend was arrested on friday for shoplifting from target he stole a bottle of cologne and a dvd it added up to about 50 something dollars, i know that they will reduce his charge to petty theft a misdemeanor but he is already on summary probation.

    do you think they will just give him a lot of community service and formal probation?

    plus he has already done 5 days timed served..

    FYI he is on summary probation for DUI

    So he has already been to jail? They will likely make him serve out the remainder of his DUI sentence.

    he was in jail for 2 days before going to court for his DUI, but it was his first offense

    If he did the jail time for a prior theft, then THIS theft could be charged as a felony (PC 666). If only for another charge - the DUI, for instance - then he faces the possibility that the original charge will rise from the dead and he will be forced to do time for that AND the new one.

    In reality, he will likely face some small jail time and/or additional probation.

    yeah i expect a harsher probation and maybe fines

    but the other thing is that he recently got a ticket for Felony Vandalism, but he wanted to fight the ticket if they bring that up in court and he got sentenced for that too how long in jail time are we looking at if any?

    a couple months?

    actually he is just being held until his court date which is the 5 days time served. he has never actually been sentenced and sent to jail

    Okay, this just gets weirder and weirder ... first, you do not get a "ticket" for FELONY vandalism, you get arrested and booked. By law, one cannot be cited and released on a felony. A judge might release him O/R pending a court date, but he doesn't get a ticket.

    Second, this guy is a one man crime wave! DUI ... on probation ... vandalism ... theft ...

    Third, you MUST be able to do better than this guy? Stay with him and it appears that your future will consist of raising bail money, working to pay off his fines, and a future on welfare because no one is going to employ a thief!

    Are there any more crimes you want to tell us about?

    He might expect to be doing his time for one or both offenses then. Your relationship might consist of seeing each other on visiting days, or, regular visits to see his probation officer down the road. Plus, don't forget that if you two live together, the police and the probation department can enter your house pretty much ANY TIME THEY PLEASE! They will be able to toss the house looking for stuff and they will be able to do it at most any hour of the day or night with or without cause.

    Is this the life you want to lead?
