Legally, interest can be added to a CS arrearage.
What was the original amount of arrears, without the interest added?
How long had the arrears been owed?
However, quite often the NCP wins in court when they have faithfully made payments on the arrears, were never told what the interest is, then they think that have it paid off, just to be hit with a ridiculous sum in interest.
If you wish, you can hire an attorney, but it might be a waste of your money since the state attorney will be in court anyway.

Not sure. Divorced in 1986; Starting receiving half ($100) of my $200/mo support in 1998; Recent years has caught up to paying the $200/mo; I had filed with the TAG in 1992 to no avail and had to hire Child Support Enforcement to get the support in 1998 going.
He is stating he was not aware of the interest although he contacted TAG in Feb 2008. I also tried to negotiate a final payoff last summer so this would be done. I always checked the balance on the website which he also has access to. I don't think that's an excuse but I believe that is what he will use as there is nothing else.
I guess my concern is if he has hired an attorney then they apparently think they can get this thing dropped. I know using TAG is not as good as using my own attorney but I cannot afford one.

The current balance is $23,000. According to my ex's records, he has paid all the actual "child support" and only owes the interest if he owes that at all.

Since the decision could go either way, you probably shouldn't spend the money on an attorney, since the state attorney will be there.

I'm not sure still. He is using the excuse he was not aware of the interest and trying to get me to admit I wasn't either. But I was aware of the balance and have been for awhile. I think if I get an attorney I have a better shot of this not getting dismissed but again, not sure and really can't afford one. Will if I have too though. Thanks.
