    Emancipation in Florida, 16 Years Old
    i live in Florida. i am 16 and i am currently living with a family from church. they are my temporary guardians. Currently I have been miserable here, they accuse me of things that I dont do, punish me for them, force me to go to their church, restrict me from barely leaving the house and wont let me home alone. My social worker said that if I wanted to leave again, they would have to put me in foster care. Recently I've reavealed that I've had a father which his name isnt on my birth certificate, and I've decided to live with him, seeing that it could take up to 9 months before they could settle me over there with him, I'm am very anxious to leave now, I really can't stand it here. My question is, how would I go about getting emancipated because my interest is not in foster care. I have a 4.0 GPA, a steady minimum wage job, and I am a very determined worker. The only problem is, I dont know how I would support myself, I dont have a car or even my lisence yet, but I have my permit. And what about medical? Do they have some programs that would help you in the begining when you get emancipated? and also, who has permission for me to get emancipated? my temporary guardians, the state, or my dad? Please help!

    You would need to be able to prove to the court that you are already able to fully support yourself. Since you can't do that at this point, emanciaption is not an option.

    In FL the parents, or legal guardians have to file the petition. Once you can prove that you can support yourself, are your parents or legal guardians willing to file the petition?

    Furthermore, there are VERY few petitions for emancipation that are granted. In order for it to be granted, you must prove to the court that you are better off without your parents. Simply being unhappy with your parents or guardian is not going to win the day.
