Can Apartment Office Evict for Losing My Rent Money
I have lived in this complex in Plano, texas for the last 8 months now, and i have always paid my rent on time with money orders, and lately there has been new faces in the office that i havent met or noticed before.

The problem began last month, i paid my rent on Jan 3rd, 2009 via two money orders, they aparently lost them and left a note on my door saying i didnt pay my rent and that i needed to do it as soon as possible, i went to the office and they stated that somebody had a problem with the cashing of money orders and if the problem was on their end to drop the letter they left on my door in the drop box so i did.

Well as of Feb 3rd, 2009 i paid my rent with two more money orders for a total of $1021.00 i kept both of my money order stubs in the console of my truck. As of today Feb 13th, 2009, i get a notice on my door that i need to vacate the premises as of Feb 16th, 2009 due to not paying my rent again and stating that i owe them $1105.86, how i dont know.

So i did what anybody else would i grabbed the money order stubs and called the 1-800 number on the back and checked the status of the two money orders that i purchased and gave to the leasing office, 1 money order in the amount of $1000.00 was never processed, it said on the voice operated phone that it hasn't been cashed it is still outstanding, and the 2nd money order in the amount of $21.00 was processed and cashed as of Feb 4th, 2009. Akward? I would say so.

So my question is what am i to do? They want me out and are saying that i didnt pay them when i have? And if they dont believe me or accept the fact that i have my money order stubs for Feb 3rd, what's to keep this from affecting my rental history and keeping me from other living places?? Is there anyway to get this straightened out this time? Because from now on, they are going to be giving me a receipt but just dont know it yet, i havent spoken to them about the situation, i had to take the day off from work tomorrow so i could handle it.

Your money orders stubs prove you bought money orders. They don't prove you paid your rent with them...

I realize that ship has already sailed, but why in the world have you been paying rent with money orders, without getting a receipt?

Your money order stubs - unlike canceled checks - prove nothing. The trace on the smaller money order should show who it was paid to, but that still leaves the larger one outstanding, with no proof that you ever paid your rent.
