My question involves criminal law for the state of: Arizona
I have been charged with criminal damage for smashing somebodys car windshield, what will happen to me now?
i smashed somebodys windshield after arguing with them.
C'mon, tell the whole story.
The trashcan, the fight, the whole thing.
How you committed a felony destruction of property and now want everyone to say it was the other guy's fault.
How you have been told on, what, four other boards that you are in real trouble and need an attorney.
Then allow me to give you the same advice.
At trial, plead innocent and ask for a public defender.
Then do what that attorney tells you to do.
Is this your 1st time getting in trouble?What is the exact charge? Is this the only charge? What level felony is it? You want to hope that the charge can be reduced to a misdemeanor.
Once you plead not guilty,your legal aid will try and work out a plea bargain w. the da. Ask your legal aid what he thinks the outcome will be.They will have a better idea of the outcome then any of us. Stay out of trouble,save up money to pay for the window(this will help your case).Let your legal aid do all the talking and follow there advice. You always want to tell your lawyer the whole story and leave nothing out.
B. Criminal damage is punished as follows:
1. Criminal damage is a class 4 felony if the person recklessly damages property of another in an amount of ten thousand dollars or more, or if the person recklessly causes impairment of the functioning of any utility.
2. Criminal damage is a class 5 felony if the person recklessly damages property of another in an amount of two thousand dollars or more but less than ten thousand dollars.
3. Criminal damage is a class 6 felony if the person recklessly damages property of another in an amount of more than two hundred fifty dollars but less than two thousand dollars.
4. In all other cases criminal damage is a class 2 misdemeanor.
