Charges Based on Extent of Bodily Injury
My question involves criminal law for the state of: texas

I am wondering if my cas will be inhanced from assault of a family member to aggrivated assault, pending what the hospitel says as far as the injuries sustatined. The vivctim claims that her ckeek and nose are fractured and her eye is black and swollen. She also said that she had a mild concussion. At what point will the judge decided (if so) to inhance my charge.

Also I am on parole for a felony 3rd dui?

    Thank you for your help.

The judge doesn't do that. The exact crime(s) you'll be charged with is up to the State/District Attorney. Fractured bones (of any size in any location) usually see an "aggravated" charge, because those injuries are more severe than bruising/soreness. Already being on parole for a felony makes you sweet meat for the prosecution, so be prepared for them to bring the highest level of charge they can muster.
