Permanent Resident Married to Non-Resident-Out of Status
I am permanent resident when I married my 3yrs live-in partner and he's undocumented for he overstayed from his visitor's visa.
We got married in Aug2008, by Jan.2009 I filed my citizenship. We plan to file I130, I485 and I765, soon after I get my certificates.

Here's my worries, when we got married in Las Vegas he wrote down his address he has on his passport...which is different from where we actually lives... he was afraid that his passport is the only valid ID he can show that's why he just followed what was on it.

On our marriage certificate it shows his address is different from mine or where we really lives... Would this be a problem? Should we need to change his address from our marriage certificates and affidavits before filing my petition? Do we also need a lawyer for his case?

I greatly appreciate your opinion on my case. Thank you in advance.

If you mean, if you report living at different addresses, will the government potentially question whether you in fact live together as husband and wife? Of course.

How do you propose to change your application for a marriage license after the marriage has occurred?
