Lewd and Lascivious Conduct Laws
Recently in my family we have run into a legal issue involving lude and lacivious conduct. My son (18 ) and his girlfriend (16) were caught in the back of his car "hooking up" the police officer who arrived did not actually witness anything except them putting the last articles of their clothing on. He wrote a Field Contact Report on each of them. However, I am worried about the legal trouble my son could be in. He is legally an adult and she is only 16. The parents arent pressing charges and they were not having sex. I have heard many different consequences ranging form him going to jail all the way to nothing at all. I'm just really confused about the whole thing. Does anyone have a real answer about the charges he might face in Florida?
Lewd and Lascivious Conduct
Is this the statute charged?
Quote:
Quoting Florida Statutes, Section 800.03 - Exposure of sexual organs.

Violation of this section is a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083. A mother's breastfeeding of her baby does not under any circumstance violate this section.
