    Can Grandparents Take Incarcerated Parents Rights Away
    My question involves criminal law for the state of: California. I know these two parents who are both in jail. The father is getting out in May. The maternal parents are filing custody papers to take custody of there child together. Can either of the parents contest giving up there legal custody for the children? Will either parent be able to take physical custody back once they get released?

    Yes, they can contest the action. Obviously, though, somebody has to look after the kids and, due to some very bad choices, mom and dad can't.

    The conditions under which they can regain custody will likely be set forth in the order issued by the court.
