My question involves a traffic ticket from the state of: PA
I was just wondering if this case is worth fighting. I got a ticket at 10:45 am while parking in the company truck doing a company delivery. We were going to move the Washer and Dryer off the truck onto the side walk near the house. We were parked on a hill but were not blocking line of sight on any vehicle (they could clearly see around us and we had our hazards on.) We went to the door to make contact and establish where the equipment was to be set up at. Approximately two minuets later we walked outside to see a cop sitting there with his lights on. We ask the cop if we did something on he said this is bull you should of parked over on the next road over and walked it over. Its a 250 pound washer across a not really that busy but icy hill Pa-948. The cop immediately asked me for my license and told me that's all he needed. When i tried to tell him i had a change of address card he interrupted me and said all he needed was my license he did not ask for registration or insurance. Then he told me to immediately move the vehicle to the adjacent road. It was a box truck. He told us to go ahead and do what we were doing while he looks into this. So as we carry the washer and dryer across the icy road dodging traffic he stays in his car the whole time. After we got everything delieverd he gives me a ticket for Prohibitions in specified places. Defendant did park box truck and leave unattended along ......ave. Sr948< blocking north land. I am in a commercial vehicle licensed by the DOTP.
Now the PAVC states 3353 Prohibitions in specific places (a) general rule - except when necessary to avoid conflict with other traffic or to protect the safety of ANY person or vehicle or in compliance with the law on the directions of a police officer or official traffic control vehicle, no person shall...
Since i cannot not afford the ticket and believe i was in danger carrying such a heavy piece of merchandise across the road i think i should fight this. Not mentioning the cop didn't ask me for (a) my registration, (b) my insurance, then made me move the vehicle. and (c) wouldn't let me finish the sentence to give him my change of addressee card. The biggest thing that makes me mad is he watched us the whole time carrying the piece of merchandise when i couldn't see because of the size of the merchandise the lid blocked my entire view while carrying it. (They are spring loaded lids.) across the road up the embankment through the snow. The whole time he didn't bother to direct traffic and didn't seem at all concerned with our safety.
He was a rookie cop, probably fresh out of the academy it took him 35 minuets to look up the infraction and another 10 to write down the amount while standing their lecturing me.
Just wanted to get a opinion.
