The Parole Officer has to prove that she had a sexual affair, a box of condoms does not meet this burden of proof.
Agreed.
However, it does satisfy "probable cause".
Re: Violation of Probation
My friend didn't think BC pills and condoms could have an other use and she confessed being sexually active. Her OP found too on her cell phone nude pictures of herself with a man. She made a mistake and is now scared being sent for years in a state prison. Do you think she could receive a harsh sentence ?
Re: Violation of Probation
In short, YES. Penalties will be harsh for violating a sex offense probation.
Re: Violation of Probation
What does she face ? Many years in prison ? Her mistake didn't hurt anybody.
Re: Violation of Probation
A popular opinion held by many sex offenders, but one not held by the law or the courts. And willful, wonton act isn't a mistake - it's a CHOICE.
Re: Violation of Probation
I'd tell her to be prepared for at least 1 year behind bars.

What you, and her, need to get your arms around is that a court order is just that... an ORDER.
Not a suggestion or a guideline. A court order holds the force of law for those named within it.
She had a court order to live like an elderly nun. She violated that order.

She had a court order to live like an elderly nun. She violated that order.
But the problem is she isn't an elderly nun, but a young and attractive woman. She received a harsh sentence : 18 new months in prison and she'll be registered as sex offender for life.

Which, again, does not allow her to ignore the court ordered parameters of her probation.
You think it was harsh. Means nothing.
She thinks it was harsh. Means nothing.
The judge thought it was appropriate. Means everything.
By the way, it is entirely appropriate that a teacher that has a sexual relationship with a student is registered as a sex offender.
