Violation of Probation

My question involves criminal law for the state of: arizona

A friend of mine served time because she had sex with one of her students when she was a teacher. She is now on probation. Her PO found at her home condoms and birth control pills. But according to the conditions of probation she had to notify her probation officer "of any new or existing romantic or sexual relationship". Because of the pills, her PO knows she had sex with a man without his permission. My friend is now scared. Can she be jailed again because she had an sexual affair with this man and didn't tell about it with her PO. Being in prison was very painful for her and being locked up again is a nightmare.

Yep, if she violates her probation, she can go back. Is she just a slow learner? There are rules, and there are penalties for violations of rules. In her case, the rules were set by probation, and the penalties include going back behind bars. If she has serious impulse control problems, she needs to either be getting herself some professional help in curbing her behaviors, or the state will put her back where THEY can control them.

If the "other man" was a child and jail was painful for her, she is really gonna hate what happens next.

Yes, but she used BC pills to avoid pregnancy : she was again sexually active. So her PO stated she violated her probation and my friend is now in custody without bond because she "splept" with a man. She'll be sentenced next month. I don't know what she faces but it's the second time she'll serve time because of sex offense.

I don't understand how the parole officer concluded she was having a relationship from only seeing the condoms and BC pills? They have other uses from sexual behaviour....

Unless she was actually spotted sleeping with another man, the state really has no case.

bottom line is that no way could they prove she had a sexual relationship with the guy without catching her in the act. A box of condoms she could just say she bought it as a stress reliever, you know one of those things u put powder/water in and squeeze it.

You really think a judge will buy that?

Really?

The Parole Officer has to prove that she had a sexual affair, a box of condoms does not meet this burden of proof.
