Daughter Charged With Sexual Assault
My 18 year old daugter has been charged with sexual assault on a child (less tha 17 years old)
She briefly moved in with a female friend who is 17. They had a falling out, so my daughter moved back home. The falling out was over clothes and personal property my daughter was missing. The friend would steal and hide my daughter's belongings. 12 days after my daughter moved out, her friend, brother and mom filed charges against my daughter. (This family has a history of doing this.)They are stating she had sex with the brother who is 15. There is no evidence, just a he said ,she said situation. We had to bond her out of jail. Bail was $50,000 and get a lawyer. How is it a family can make false claims, and possibly ruin a young girl's life Over some clothes?!
To make matters worse the "friend "came into my daughter's place of business and left copies of her jail record and criminal case on the counter, thus causing her embarassment at work. Keep in mind you can obtain records online of ANY pending criminal case. Rumors have been spread around about my daughter and she has not been convicted! She receives daily calls or text messages from the "friend " ever since she left the documents at her place of business. We have filed a police report and keep track of the harassing calls. She uses friend's cell phones or blocks the number. We know it is her due to the content of the messages.What can we do? We go to the arrainment in a week. I want to know what we can do about this "friend" who is harrassing, and defamation of my daughter's charactor? My lawyer has stated that it could be an ugly and costly suit if we wanted to sue them for putting us through all this. The charges are false and have been done maliciously. what legal rights do we have?[/b]

It sounds like you are taking appropriate steps in relation to the harassing calls, by documenting them and working with the police. Your daughter's lawyer can advise her as to what additional steps may be taken. For now, it seems that her focus needs to be on her criminal case - winning that is far more important to her future than a possible civil lawsuit.
