Losing Guardianship
My question involves guardianship in the State of: IN
I have had Legal guardianship of a little girl for about 2 years now. Her mother is supposed to visit with her for 4 hours a week but since I have had her she has not been part of her life she has probably visited about 5 times. Now she is claiming that she is going to take her away because she wants her back, she has told people that she is doing it just to spite me. she has been living from place to place and parties all the time. How possible is it for her to get her child back???? i am very concerned because the baby is now going to be 3 years old and is very attached to our family..

You have a legal guardianship, meaning through a court? Then she can regain custody by satisfying whatever conditions the court has imposed for her to regain custody. You should consult a lawyer about whether, under the facts of your case and terms of the custody order, you have legal standing to try to gain full custody.

Thanks for the reply and Yes it is through court, I consulted with a DCS Lawyer and he said that in the state of Indiana if the parent makes no attempt to see the child within a year then we can adopt without the mothers consent. thanks.
