Probation Violation For Non-Reporting
My question involves criminal law for the state of: Georgia My son was placed on non-reporting probation in Jan. 08. In Jan. 09 he was arrested for violation of probation. His PO told him he was violated for not reporting. The reason was not sending in some kind of information change paper. How can she do this when no changes happened? She offered him 6 months revoked and he refused. She came back and offered him 3 months and again he refused. He is still incarcerated.
Re: Probation Violation For Non-Reporting
If he violated his probation, then he violated his probation.
If he received a "change paper" informing him of new probation terms, he should have abided by the terms. Is that what you're saying - he was supposed to return something acknowledging the new probation terms, but chose to disregard the notice and failed to comply with the new terms?
