Is a Suspension for Bowl Necklace Legitimate
My question involves criminal law for the state of: Missouri
I am 17 and live in Missouri and i am a Junior in highschool. Last week when i was walking out of lunch, a teacher noticed my necklace and stoped me. She said i know what that is and then got the resoruce officer and he said you are SOL. The necklace is a small blown glass peice that resembles a bowl used for tabacco and some cases weed. The necklace peice had no resin in it and it did not reresent a bowl to me, it was a cool looking glass piece on a necklace. In the end i got ten days OSS and a drug charge on my school record.. Is there any way i can fight this, or atleast get it off my record? thanks, tj

Most schools have a Zero Tolerance policy with respect to drugs and paraphernalia. That means, resin or no, you can be punished under the school's policies, with little to no recourse.

I'm afraid I'm not buying the "doesn't represent a bowl to me" angle. If you can smoke with it, it's a bowl, and at your age, you're well aware of that. If you intend to fight it, get your parents involved, but understand that you're going to have a hard time convincing school officials that you didn't know what it was.

In most cases, when you buy jewelry in a head shop, don't wear it to school.

I, also, don't buy it for a second.

I notice you didn't say that you never smoked.

Although I am reminded of a totally straight-laced foreign-born engineer who was genuinely shocked to learn that the "palm tree" on the Jerry Garcia tie he wore to work was....
