Hi, I live in the state of Tennessee. I am 18 and my girlfriend is 17. Since Tennessee doesn't have any emancipation statue, can she just come live with me, or does her parents have to sign her over to me. Is there anything I can do to help? Thanks for your time.
Emancipation in Tennessee
The absence of an emancipation statute does not make emancipation automatic; absent a clear common law path to emancipation, and the pursuit of that option to the point of getting a court order of emancipation, it makes it more difficult. When an unemancipated minor moves out without parental consent it is called "running away", the minor can be made to return home, and any person who knowingly shelters her could be potentially charged with a "harboring a runaway"-type criminal offense.
