When Can My Father Reenter the United States
My father is a citizen of Portugal. He was sponsored by my grandfather to come here in 1983.
He was deported in April of 2005 on the basis of a felony conviction back in 2000. His family remains here in the United States?
2010 will be 5 years since his deportation. I have herd that he can apply for readmission at the five year mark. However, I was also informed that he has no chance of being readmitted for the reason that he was deported (i.e. felony conviction). I am having a difficult time finding answers. Which is the truth?
Re: When Can My Father Reenter the United States
Without knowing more of the details, I can't begin to guess about his eligibility to return. If he was convicted of an aggravated felony, I would not expect him to be permitted to return. But I have no information about his conviction charge.
Re: When Can My Father Reenter the United States
He was charged and convicted of maiming by mob in the state of Virginia.
I am not sure weather or not this is considered an aggravated felony, but if it is, is there ANYTHING we can do? (such as, to try to appeal his case?)
Thank You.
