Assault 2 - Possible Deal
My question involves criminal law for the state of: Kentucky
I was recently charged with an assault 2. I was doing an internship for a large global company at the time.
My lawyer says that my case is winnable. However, there are a couple things that I have on my side that are not strong points.
A guy had attacked me and weighs a good 90 lbs more than me. So I ended up pulling a pocket knife and hit him twice. I did not know that I had actually hit him with the knife. I did not call the police and neither did he. He drove himself to the hospital and they reported it to the police who took his side.
They took my statement along with 2 other people that were with me. They allowed for the attacker to go home with his family and type up the statements and bring them to the police station the next day.
My court date is very soon. My offer now is I take the felony charge and I get probation. I'm scared to go to trial because I'm asian and I have heard things about kentucky.
My lawyer says that overall the case is winnable. But I know that there are no garuntees. I just don't see how some 40 year old would attack a college kid.
If I do take that deal, how hard is it to find a job? I'm studying chemical engineering at Case Western Reserve University.
Also, is there going to be any changes made to kentucky's law that will allow felony expunges?

oh and I have nothing on my record except for 1 speeding ticket about 4 years ago in high school.

Direct these questions to your lawyer. If you don't trust him/her, then hire another one.
Also, any changes to Kentucky expungement laws is not going to come in the timeframe you're facing, if changes come at all regarding felony convictions. So no, it won't help you.

I talked to my lawyer already. The thing is he can't really tell me to take the deal or not.
I really just worried about how this will affect my employment in the future.
I really don't plan on getting in trouble.

And for some reason you believe that random people, who know far less about your case, can advise you better than your lawyer?

What does he think the penalty would be if your found guilty? A criminal conviction especially a violent felony is gonna effect your employment. A local lawyer is someone who could give you the best answer.

Just my opinion, I have found if they offer you just probation, take it and go. I got offered probation on a battery charge in georgia, denied it, took it to trial bc me and my lawyer both thought it was open/shut case, and the jury found me guilty and I got 180 days in jail. The court system is basically like the lottery. You never know what idiots you will get on the jury. If you are convicted, you may be looking at prison time. I personally wouldnt risk it.

A degree from Case cost roughly 50 grand a year (and I'm probably being conservative). He's got a bit more riding on this than the average bear. A violent felony conviction WILL make it extremely difficult to find employment even with a degree from Case.

It's a horrible situation to be in. He could face a few years in prison which would scare the hell out of me.The penalty for a violent felony is also severe.It might even help to talk to a different lawyer,it's prob to late for that.
