Credit Card Wants Payment For Unauthorized Charge
My question involves a banking matter in the State of: NY
I live in NY, bank is UT. Trying to be brief: Had problem with an unauthorized charge in Aug. Contacted Cap1 and temp credit applied then reversedbecausetThey assigned to fraud instead of dispute, and no fraud was found. after 3 mos +many calls they re-opened under dispute. 30 days later they sent an unsigned receipt as proof of valid charge. charge is not valid. also, I think FTC requires resolution in 90days or 3 statements? i have a great credit rating, i really sense they're waiting me out to see if I just pay the $161.88, and i am concerned enough to consider that. filed complaint with FTC who says i can file suit. Obviously paying a lawyer will cost more than the 161.88 - what options do i have on my own? already requested signed receipt(again) and advised them of the FTC rules on Fair credit Act, asking for perm dismissal of charge. appreciate your assistance.

You say it's unauthorized. The credit card company doesn't believe you. If you can file a lawsuit over this dispute, and want to take your chances in court, there you go. For small amounts, consider small claims court; although they'll probably try to move you to a regular trial court if permitted under NY law. If you believe they've violated credit laws, consult a lawyer in your area who handles that type of case and see if he'll take your case in anticipation of statutory attorney fees.
