Father's Name on Birth Certificate

My question involves name change laws in the State of: Virginia

My ex and i were not married when our daughter was born. She was married to her now ex-husband when my daughter was born, but i am listed as the father on my daughters birth certificate. The mother keeps threatening to change my daughters name on birth certificate to her ex husbands last name since he has retained her married name. Do i have any recourse to stop her from changing my daughters last name?

She can't just mosey in and change the name as she pleases.

She'll need to petition the court, and show that the name change is in the best interests of the child. She will also be required to notify you of the petition, and you can oppose it.

The courts rarely grant name changes to those seeking them out of spite.
