How Many Payments Can Be Missed Before Repo
My question involves an auto loan or repossession in the State of: Florida
How many payments can be missed before repossession? I have just missed my first one (30 days late) with citifinancial auto. Generally when do they repossess and must they notify me in writing before the process begins?
Re: Payments That Can Be Missed Before Repo
In most instances, your vehicle can be repossessed if you're even one day late.
Whether or when the lender chooses to do so depends on the lender and your history with the lender. We couldn't begin to guess what Citi would do.
Notice is not required, as the terms of your agreement will spell out when they may repossess.
Re: How Many Payments Can Be Missed Before Repo
Per the Attorney General's office Florida:
Generally, your creditor has legal authority to seize your car as soon as you default on your loan. Once you are in default, your creditor may repossess your car at any hour of the day or night, without prior notice. The creditor may also come onto your property to do so. However, the creditor may not commit a "breach of the peace" by using physical force or threats of force.
