I am in my early 40's.
2004 April I was arrested first time for petty theft at Safeway ($ 85 in 2 bottle of alcohol)
No police or jail time…$270 civil demand 4 Safeway
Court Charges: 484/488 petty theft
3 year probation
5 days work Alternative program $150+$120
3 hr. AA meeting per 2 month.
2005 December
Shoplifting charges at COSTCO ($ 250 in 2 bottle of alcohol)
Police arrest me and I spend 3 days in jail (charges PC 484/666, 1203.2)
I have a court date coming up in month or so....
I know that a second arrest for petty theft may be filed and punished as a felony
and carries a maximum of one year in either county jail or state prison.
I’m looking for Criminal Attorney, assumed this would be the best way to go…..
I also start AA meeting again and Alcohol and Psychological Treatment in Counseling Center.
Any reasoning what will be my punishment for this, I’m very worried about jail time !!!

It's been my experience that when you're charged with Petty theft/666pc somebody doesn't like you for some reason. I've known several times when a person has been caught on more than one occasion and was only charged with 488pc. Could be the DA has a plan for the fast track for himself, you need a good lawyer, stay clean and sober and as the saying goes...."Come to Jesus." If you don't beat this I'd say 6 months to 1 yr is a good possibility.

California Penal Code or CPC is as follows:
484CPC petty theft defined
488CPC petty theft
459CPC commercial burglary
459CPC is not always the next step up, it can be defined as to how you committed the crime or your intent when it was committed. Meaning it can be a low dollar amount but how you did the deed that makes it a felony. Last time I heard it was $25,000 bail......no small chunk of change.
