Theft by Conversion by Employee I Think
My question involves criminal law for the state of: GA
I have found out a employee has been using our company vehicle and equipment to do work for our customers at a discounted (cash) rate and then pockets the money without reporting it to the office. He would tell us he was stuck in traffic or running late( so he would drive home to save time and gas) and then tell us he would come back in the morning to get the next days work and turn in the work orders we had issued to him. At some point over the last 5-6 months he has been converting some of our customers to his own and using our equipment and materials on his own to make a nice profit.

We believe he has converted between $400 and $1500 dollars this way. What can we do to recoup our loss?

    Thanks!

you confront him and tell him to repay the amounts to you immediately.

    Then you fire him.

You cannot take the money out of his paycheck, but you can take him to small claims court for it.
