    Caught for Shoplifting in New York
    My question involves criminal law for the state of: New York

    Yesterday, I was caught for stealing worth $ 17.74 (including Tax) in Wal-Mart. LP Officers questioned me for the stealing and I admitted for it.

    My husband was with me. But stolen stuff was in my bag and it was my idea to steal things. I had No Id to give but my husband had his Driving License.

    LP officers filled a form, wrote Address from DL (I requested them to write only my name and not my husbands as it was my fault. They did cut his name from form as they also said since stolen stuff was in my bag I am responsible for stealing not my husband).

    They did NOT take a photo of my husband or me OR did NOT ask us to sign any document. I was very afraid so in fear I gave them wrong name and wrong birth of date but they have correct Address from my Husband DL.
    After this they asked us to leave the room; we purchased all things, which I had stolen.

    No police were called and I am not asked to sign on any of the documents. We did do purchase of $28.02 before we left the store and before LP stopped us.

    I am feeling ashamed of myself for the stupid thing I have done.

    My questions are:
    1) What action will Wal-Mart take on me/us?
    2) Will I/we be prosecuted for the theft?
    3) Will this be logged to my/our Background check reports?
    4) Will I/we receive Civil Recovery letter and will have to pay high fine?
    5) Are we trespass from Wal-Mart? (If yes, for how many years?)
    6) How to make sure that we r NOT trespass
    7) Is there any way we can pay a fine and close all this
    8) If we r tresspassed is that mean we cant not go to ANY Wal-Mart?

    We don’t know name of the LP officer and not sure they made copy of my husbands DL or not

    Please let me know as much details as possible. Thanks!

    Based on your post I would say Civil Demand only
    2) Will I/we be prosecuted for the theft?
    No police gnerally means store is not seeking to prosecute
    3) Will this be logged to my/our Background check reports?
    NO criminal charges means no criminal record outside of store an dany retail theft database they may input your names into
    4) Will I/we receive Civil Recovery letter and will have to pay high fine?
    Yes
    5) Are we trespass from Wal-Mart? (If yes, for how many years?)
    If they banned you just stay out
    6) How to make sure that we r NOT trespass
    Ask them
    7) Is there any way we can pay a fine and close all this
    Once you pay Civil Demand its over
    8) If we r tresspassed is that mean we cant not go to ANY Wal-Mart?
    Probably but thats hard to enforce

    When should I expect Civil Demand is week or 2? How much it will be (minimum charge).

    I m very affraid as I read some where that WM can file charges in 1 year (i.e. WM has time limit of 1 Yr. to file charges agains me) is that tru? Pls. Pls. Help.

    Civil Demand can show up in days, weeks even, months. Far as pressing charges Walmart has until statute of limitations runs out to file. Depending on state that can be anywhere from one to two years

    If in case I m trespassed and I go to the store how they will recognize me as they did NOT take my photo?

    I don't know name of LP officers who caught me so whom shd I call in WM n wht shd I ask: I/We r tresspassed or not? Please Help.

    The solution is to shop at Target, Kmart etc instead.
