DUI and Possession of Hydrocodone

My question involves criminal law for the state of: FL. My brother was recently charged with a DUI and possession of hydrocodone. Does anyone know minimum and maximum sentences. The possession charge is a felony charge, is that common practice. Or is it by amount.

What are the statutes under which he is charged?

Did your brother have a Rx for the Hydrocodone? and just how many pills did he have?

It is a felony to have hydrocodone without a prescription and it can be a federal crime as well, it depends how many he had and how he obtained them.

Unlawful possession of hydrocodone is a third degree felony. Charges can be more serious if it's an amount indicative of trafficking. A third degree felony is punishable by a fine of up to $5,000, and up to five years in prison. If the defendant has a prior criminal record, it may be possible for a greater sentence to be imposed.

Is posession of hydrocodone a misdemeanor class a or a felony in Texas?

When i got arrested I had 4 hydrocodone pills in my person however i live in Texas and the officer informed me posession of a controlled substance, in this case the pills,which before was a felony and had recently changed to a classs a misdemeanor?

If you do not have a Rx for them it is a felony.
