Do I Have a Misdemeanor

My question involves criminal law for the state of Texas: An officer found me and my guy kissing in his car on a college campus. He then checked our ids and took down his licenese plate. I said we have a misdemeanor because we weren't doing anything illegal. I've been reading about misdemeanors but it sounds like the person usually receives a ticket or fine and i have received neither. So do i have a misdemeanor or is this guy just trying to scare us?

The crime, if any, would hardly be a felony. There is little 2 consenting adults of age can do in a car that would rise to being felonious. You reference he caught you kissing an not planning out a robbery, is what I mean.


Criminal law jurisdiction of state campus police varies by state, but assuming he can cite/arrest for misdemenaors, he would have done so at that point probably.


Unless you were in a closed area, say, no parking after X o'clock, there is very little chance you were trespassing.


Even if so, most infractions of this level are handled internally. You are College students, right?

If you were in a place you had a right to be and generally out of public view if the kissing was prolonged so as not to be taken as anything but just that by a passing observer, it is not a crime.
