Shoplifting Case in Los Angeles
My question involves criminal law for the state of: CA
I was arrested for a shoplifting case in Los Angeles, My lawyer plead "Not guilty" during arraignment. I have "Pretrial Hearing" in feb-2009. My lawyer is trying to get a deal with the DA.
I'm interested to know if I can opt for Diversion program at this stage, this is my first offence. Any advise/suggesions is much appreciated. Thanks in advance.
Re: Shoplifting Case in Los Angeles
I would think yes but discuss this with your Attorney
Re: Shoplifting Case in Los Angeles
Looks like my lawyer spoke to DA about pretrial diversion, but DA did not agree to it. What can be done now. Should I insist my lawyer to talk one more time. Any other way to get this diversion? Please help with sugessions.
Re: Shoplifting Case in Los Angeles
Did your Lawyer say why it was denied?
Re: Shoplifting Case in Los Angeles
DA denied this as they think they have done a lot of good by bringing the Felony down to a Misdemenour.
Re: Shoplifting Case in Los Angeles
Ok theres your reason and I am not surprised. Its very very rare (if ever) see an original Felony charge offered Diversion. Ask your Lawyer about expunging your conviction (if convicted) and how long you must wait if even possilble
Re: Shoplifting Case in Los Angeles
My Attorney is still working on a deal with the DA. What will be the best deal in this case taking immigration into consideration.
Re: Shoplifting Case in Los Angeles
That advice would best come from your Attorney
Re: Shoplifting Case in Los Angeles
I'm seeing(from forums) quite a number of felony charges given pretrial diversion (I understand each case is different). Any possibility that I can request for diversion. I'm a first time offender with good credit history and conduct.
I'm asking again as I may not have problems with immigration and employment. Panther, can you please help.
Re: Shoplifting Case in Los Angeles
What were you charged with to begin with? I know it was a felony, but how much are we talking about?
